SCG Witchery is operated by Charmes De Sorcellerie Du Québec, doing business as SCG Witchery (referred to as “SCG Witchery,” “we,” “us,” or “our”).

1. Agreement to Terms

Welcome to SCG Witchery. These Terms of Service ("Terms") constitute a legally binding agreement between you and Charmes De Sorcellerie Du Québec regarding your access to and use of the website located at [https://www.scgwitchery.com](https://www.scgwitchery.com) (the "Site") and the purchase of our products and services.

By accessing the Site or purchasing any Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access the Site or use our Services.

2. Age and Eligibility

By using this Site, you represent and warrant that you are at least eighteen (18) years of age. Our services and products involve mature themes, occult subject matter, and botanical curios that are not suitable for minors. We do not knowingly collect information from or sell to individuals under the legal age of majority.

3. Nature of Services & Legal Disclaimer

3.1 Service Description

SCG Witchery offers products and services related to esoteric practices, witchcraft, and spiritual exploration. These include, but are not limited to, ritual work, consultations, divination, and the sale of curios.

3.2 Subjectivity of Experience

You acknowledge that the results of spiritual and energetic work are subjective and vary based on individual belief, interpretation, and personal effort. We do not guarantee specific supernatural or material results.

3.3 For Entertainment and Spiritual Purposes Only

In accordance with legal requirements, we state that all services, readings, and metaphysical products are sold for entertainment, spiritual, and educational purposes only.

3.4 Professional Disclaimer

The information and guidance provided by SCG Witchery do not constitute medical, psychological, legal, or financial advice. We are not licensed medical professionals or attorneys. You should not disregard professional advice or delay in seeking it because of information received from us.

4. User Accounts and Security

To access certain features of the Site, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms or engage in fraudulent activity.

5. Intellectual Property

All content on the Site—including text, graphics, logos, images, ritual structures, course materials, and the arrangement thereof—is the exclusive property of SCG Witchery and is protected by Canadian and international copyright and intellectual property laws.

You are granted a limited license to access the Site for personal use. You must not:

• Republish material from SCG Witchery.

• Sell, rent, or sub-license material from SCG Witchery.

• Reproduce, duplicate, or copy material from SCG Witchery.

6. Payments, Refunds, and Cancellation Rights (Quebec CPA Compliance)

6.1 Digital Products (Instant Downloads)

For the purchase of digital goods that are accessible immediately (e.g., PDF Grimoire pages, recorded audio meditations, or single-file downloads), the contract is considered fully performed upon the delivery of the download link. Because the nature of these files prevents their return, all sales of Digital Products are final and non-refundable.

6.2 Custom Spellwork & The Architecture Phase (Immediate Performance)

You acknowledge that "Custom Spellwork" (specifically the Telos and Gnosis tiers) is a service comprising two distinct phases:

1. The Architecture Phase: A mandatory period of research, astrological calculation, and ritual design that begins immediately upon booking.

2. The Ritual Phase: The final energetic performance.

Cancellation Policy for Custom Work:

• Design Fee: Seventy-five percent (75%) of the total Service fee is attributed to the Architecture Phase (intellectual labor and design). This portion earns out on a daily basis as the research is performed and becomes non-refundable as the work is completed.

• Ritual Fee: Twenty-five percent (25%) of the total Service fee is attributed to the final Ritual performance.

• If you cancel after the Architecture Phase is complete but before the Ritual is performed, you are entitled to a refund of the Ritual Fee (25%) only.

6.3 Standard Services & Consultations

For scheduled one-time services (e.g., Consultations or Praxis tier rituals), you may cancel your appointment without penalty up to 48 hours before the scheduled time. Cancellations made less than 48 hours in advance may be subject to a cancellation fee to cover the reservation of time and preparation materials, not exceeding the value of the service.

6.4 Non-Refundable Materials

Any specific physical materials (custom herbs, oils, candles) purchased or consecrated specifically for your working are considered "customized goods" under the Consumer Protection Act and are strictly non-refundable once processed.

7. Shipping, Customs & Returns

7.1 Shipping & Customs Liability

SCG Witchery covers the cost of standard shipping for qualifying products. However, strictly adhering to international trade regulations (including USMCA), SCG Witchery cannot predict or calculate specific border tariffs, import duties, or clearance fees.

• Client Responsibility: The determination of these costs remains the sole jurisdiction of the destination country's customs authority. The client assumes full financial responsibility for any additional fees levied at the border.

7.2 Returns of Physical Goods

Please refer to our separate Refunds & Cancellation Policy for detailed instructions on returning physical items. Note that used items, custom talismans, and botanical ingredients are non-returnable due to hygiene and energetic contamination reasons.

8. User Conduct and Comments

Certain parts of this website allow users to post comments. SCG Witchery does not filter comments prior to publication but reserves the right to remove any content deemed inappropriate, offensive, or in breach of these Terms.

• You warrant that your comments do not invade any intellectual property rights or contain defamatory, libelous, or unlawful material.

• By posting, you grant SCG Witchery a non-exclusive license to use and reproduce your comments in any media.

9. SCG Witchery AI Features

9.1 Purpose

Our AI Features (e.g., Spell Idea Generator) are provided for inspirational and entertainment purposes only.

9.2 No Guarantee

We do not guarantee the accuracy or reliability of AI-generated content. You acknowledge that AI output can be unpredictable and you use it at your own risk.

9.3 Ethical Use

You agree not to use our AI tools to generate content that is unlawful, harmful, threatening, or discriminatory.

10. Modifications to Terms (CPA Section 11.2)

10.1 Right to Amend

We reserve the right to modify non-essential elements of these Terms at any time.

10.2 Notice of Material Changes

In accordance with Section 11.2 of the Quebec Consumer Protection Act, if we make a material change to this agreement that increases your obligations or reduces ours, we will send you a written notice at least 30 days before the amendment comes into force.

10.3 Your Right to Refuse

Upon receipt of such notice, if the amendment results in an increase in your obligations or a reduction in ours, you may refuse the amendment and cancel this contract without cost or penalty by sending us a notice to that effect no later than 30 days after the amendment comes into force.

11. Limitation of Liability and Indemnification

11.1 Limitation of Liability

To the fullest extent permitted by applicable law, SCG Witchery shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or our services.

11.2 Indemnification

You agree to indemnify and hold harmless SCG Witchery, its owners, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in the judicial district of Montreal, Quebec, to resolve any legal matter arising from these Terms.
